General terms and conditions
The following General Terms and Conditions apply to all offers, contracts, deliveries and other services of the Hotel Promotion Group, hereinafter referred to as HPG
We hereby expressly object to any deviating regulations of our contractual partners; these shall only apply with our express consent. All ancillary agreements require our written confirmation to be effective.
- HPG is the publisher of HPG hotel vouchers, which can be redeemed on the bookoni.com portal, among others. As a basic service, the hotel voucher entitles 2 people to a number of nights in a double room in a partner hotel as specified on the respective voucher. The overnight stay is paid with the hotel voucher. Local taxes and other local charges are not included in the hotel voucher. In addition to this basic service, there may be the option to redeem the hotel voucher for various hotel specials and travel specials that change on an ongoing basis. These hotel or travel specials differ in the range of services from the basic service and are described on this website or other medium, if they are currently available.
- The current partner hotels available for selection are presented on this website. International Apta Group Pte. Ltd. is entitled to change the hotel offer, to remove existing partner hotels from the program permanently or temporarily (e.g. due to high booking occupancy) and to add new partner hotels. There is no claim to be able to redeem the hotel voucher at a specific partner hotel.
- Also shown on this website are occasional hotel specials/travel specials that are constantly changing. These hotel specials/travel specials are case-by-case additional offers to the basic service, which have other service contents. In principle, the hotel voucher holder is only entitled to the basic service, but may also use the hotel specials/travel specials if this is expressly offered.
- The user of the hotel voucher is obliged to accept the respective catering flat rate per person and night when booking the hotel stay for 2 persons. The cost of meals is not included in the hotel voucher and is mandatory to pay in advance according to the booking confirmation. Even in the event of partial or non-utilization of breakfast and/or meals, the user of the International Apta Group Pte. Ltd. hotel voucher is in any case obliged to pay this booked catering flat rate. The corresponding starting prices are indicated for each hotel on this website. Individual hotels also offer other meal packages. This is indicated in the specific case at the respective hotel and is the basis for the booking made.
- A hotel booking is to be made by the user of the hotel voucher exclusively via the booking department and the booking channel prescribed for this purpose (see item 6 of the GTC and/or Terms of Use). If necessary, advance booking deadlines must be observed. The accommodation contract arises directly between the user and the hotel. The booking of hotel specials or travel offers is also made exclusively via the booking department and the booking channel prescribed for this purpose (see item 6 of the GTC and/or Terms of Use). Here, the terms and conditions stated with the respective offer from this website apply.
- A hotel booking and/or request for a possible hotel booking is only valid and possible if it has been made by the traveler as a “booking request ” via the user account of the voucher holder in the form of a sent booking request by filling out and sending the booking request form. For this purpose, the voucher holder must always be logged in to his created user account to be able to send a booking request. Voucher holders must always register their voucher in advance, if they have not already done so, and create a user account in the process or add the voucher to an existing user account. Booking requests made by other means, such as telephone, email, fax or post, cannot and will not be processed and answered; they must be made expressly and exclusively via the prescribed user account. In addition, a hotel booking is only valid if the guest has received a firm booking confirmation and the payments due for the booking have been made by the traveler on time.
- All bookings are subject to the number of free rooms available to the hotel for voucher guests. Hotels make their room capacities available to various tour operators. It is therefore possible that one tour operator has already exhausted its capacity, while rooms can still be booked from another. Likewise, the booking situation in a hotel can change constantly, so that at one time of inquiry the hotel can be fully booked, but a few days later, e.g. due to cancellations, free rooms are available again. International Apta Group Pte. Ltd. has no influence. International Apta Group Pte. Ltd. does not guarantee that the user will be able to book on a specific date or, in particular, in a specific hotel.
- A reservation is only guaranteed if the hotel or the International Apta Group Pte. Ltd. booking department confirms the reservation in writing.
- The information on prices, conditions, hotel descriptions etc. on the website is provided to International Apta Group Pte. Ltd. by the participating hotels or the booking partners of International Apta Group Pte. Ltd. such as incoming agencies or similar. The hotel or the booking partners of International Apta Group Pte. Ltd. such as incoming agencies or similar are liable for the content and accuracy of the information. International Apta Group Pte. Ltd. accepts no liability for the completeness and accuracy of the information provided by the hotels or the booking partners of International Apta Group Pte. Ltd. such as incoming agencies or similar, nor is it liable for printing errors. Changes to the hotels’ offers and the conditions under which hotels offer their rooms are possible at any time and are expressly reserved. The user is therefore obliged to find out about the currently valid prices and conditions before making a booking.
- As an accommodation contract is concluded between the guest and the hotel, International Apta Group Pte. Ltd. as an intermediary is not responsible for defective, unperformed and untimely services of the hotel. Claims of the user, which are due to the hotel stay, especially claims for cancellation of the contract, reduction and compensation, can only be asserted by the guest against the hotel.
- If the user has booked with a contract hotel, he must comply with the booking. If he cancels the booking or does not use it for the full period, the hotel or International Apta Group Pte. Ltd. has the right to charge the user up to 100 % of the agreed catering flat rate for the days lost. With regard to fixed booked extension days and accompanying persons, cancellation costs will be charged according to the cancellation conditions of the respective hotel.
- The hotel vouchers are valid for up to 60 months after receipt and can only be redeemed up to this date. There is no entitlement to compensation for hotel vouchers that are not redeemed within the validity period. The hotel vouchers can only be used once and cannot be redeemed in cash. HPG accepts no liability for the loss of hotel vouchers.
- The user agrees that his personal data disclosed in the course of business transactions may be processed by International Apta Group Pte. Ltd. and passed on to the hotel as well as to companies entrusted with the processing and affiliated companies.
- Retention of title
- We reserve title to the items delivered by us (goods subject to retention of title) until full settlement of all claims arising from this contract and from the business relationship with the customer now and in the future, irrespective of the legal grounds, which arise or had already arisen at the time of conclusion of the contract.
- In particular, the pledging or transfer by way of security of goods subject to retention of title by the customer is not permitted. The customer may only transfer ownership of the goods subject to retention of title to his customers after our claims have been settled in full.
- The customer assigns to us in advance as security all claims to which he is entitled in connection with the resale, including ancillary rights and any claims against his insurers. In the event that the items are exported, the customer furthermore hereby assigns to us all claims to which it is entitled or will be entitled in the future against domestic and foreign banks in connection with the export, in particular the claims arising from collection orders, from letters of credit or letter of credit confirmations as well as from sureties and guarantees. If the goods subject to retention of title are sold by the customer together with other goods not belonging to us, whether without or after processing, the claims shall be deemed assigned to us in the amount of the invoice value of the goods subject to retention of title.
- The customer is entitled and obligated to collect the receivables from the resales despite the assignment as long as we do not revoke this authorization. He shall immediately transfer the collected amounts to us in the amount of the claims to which we are entitled.
- We shall be entitled to demand the return of the goods subject to retention of title at any time – even without withdrawing from the contract and without setting a grace period – without the customer being entitled to a right of retention or a right to refuse performance on account of payments already made.
- The customer is obliged to keep the reserved goods in proper condition.
- In addition to the General Terms and Conditions, the Terms and Conditions of Use of the Hotel Vouchers apply explicitly, which are also accepted without exception when the User uses the Vouchers.
- The purchase and use of the hotel vouchers is subject exclusively to US law.
- In deviation from the above provisions, the terms and conditions expressly stated with the respective offer shall apply to the hotel specials and the travel specials. The liability and cancellation conditions of the respective provider apply.
